Wrongful Death Lawsuit Filed Against Fayette Care Home

Two siblings have filed a wrongful death lawsuit in Fayette against a care home after their brother died in a structure fire on January 27th.

Connie Mallick and Robert Bittle filed the suit against the Linda Perkins Home in Fayette after their brother, Donald Bittle, died in the January fire.

The two siblings allege that the building was not built with a proper thermal barrier and that there were no smoke alarms on the upper floor.

The petition also says that there was no staircase connecting the upper and lower levels.

Donald Bittle was one of three residents who died in the fire that day, with his cause of determined to be smoke inhalation.

Mallick and Robert Bittle have demanded a trial by jury on all issues, according to the petition.
