A Boone County judge is holding off on a decision about whether a 17-year-old charged in a deadly Facebook Marketplace shooting will be tried as an adult.
The teen faces second-degree murder, robbery and other charges in the January death of Michael Ryan Burke.
During a hearing Wednesday, the defense presented witnesses highlighting the teen’s character and mental health, arguing he should remain in the juvenile system for rehabilitation.
Prosecutors say the violent nature of the crime and the teen’s age he turns 18 this summer support adult certification.
Investigators say the shooting happened during a planned phone sale, and court documents allege the teen later sold the stolen device.
A ruling is expected Tuesday morning.
