A man accused of murder was in Audrain County court today [Thursday] for the judge to hear motions that had been made in the case.
Richard Henry II is charged with first degree murder, first degree burglary, abandonment of a corpse and numerous other charges in relation to the death of Leon Wilder the Third in July of 2017.
The judge heard testimony from Audrain County Clerk Shelly Harvey regarding the cost of granting a change of motion. She said the cost varies from 3500 to 7 thousand dollars.
Sheriff Matt Oller testified that transporting an inmate causes significant risks, that are increased by the gravity of Henry’s charges. He said the difference between having the case in another county and Audrain is the shorter distance to the courthouse, as well having the entire sheriff’s staff at his disposal.
Wilder’s Mother, Ellen Anderson, testified she drives from St. Louis to Mexico to seek justice for her son, and would like to see the case remain in Audrain County.
The defense says the media coverage in the case would make it difficult to find an unbiased jury in Audrain County.
The judge asked the Prosecutor’s Office to make a decision if they will be seeking the death penalty against Henry by March 1st.
